Terms of Use

Your use of websites (the "Websites") owned or operated by Already Bored, LLC, a California limited liability company ("Already Bored"), is subject to the following terms of use (the "Use Terms"). By using or continuing to use the Websites, you agree to be bound by the Use Terms and any new or modified terms and conditions thereof. You further agree that Already Bored shall have the right to change the Use Terms and that each time you access the service, you accept the Use Terms as they then exists. As Is

Unless explicitly stated otherwise, any new features that are subsequently added to the Websites, including the release of updates to existing features, shall be subject to the Use Terms. You understand and agree that the Websites are provided "AS-IS" and without warranty and that Already Bored assumes no responsibility or liability of any kind for the accuracy, reliability, completeness or timeliness of the content contained on the Websites. You also understand that nothing contained on the Websites should be considered legal advice and should not be relied on as such.

You agree that you must evaluate, and bear all risks associated with, the use of any User Content, including any reliance on the accuracy, completeness, or usefulness of such User Content. In this regard, you acknowledge that you may not rely on any User Content created by Already Bored or submitted to Already Bored, including without limitation information on discussion boards, and in all other parts of the Websites.

Age Restriction; Adults Only

Certain areas of the Websites may contain adult or mature language and/or content. As such, you must be at least 18 years of age to access and view the Websites. By accessing any such area on the Websites, you certify that you are at least 18 years of age.

User Postings

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Material" or "User Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such User Content originated. Such user, and not Already Bored, is entirely responsible for all User Content uploaded, posted or otherwise transmit via the Websites. Already Bored does not guarantee the accuracy, integrity, tastefulness, or quality of any User Content. You understand that by using the Websites, you may be exposed to materials that are offensive, indecent or otherwise objectionable. Under no circumstances will Already Bored be liable in any way for any User Content, including, but not limited to, any errors or omissions in any User Content, or for any loss or damage of any kind incurred as a result of or arising from the use of any User Content.

Use Limitations

You agree to not use the Website to:

  1. upload, post, email or otherwise transmit any Material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
  2. harm minors in any way;
  3. impersonate any person or entity;
  4. disguise the origin of any Material posted on or transmitted through the Websites;
  5. upload, post, email or otherwise transmit any Material that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
  6. upload, post, email or otherwise transmit any Material that infringes any patent, trademark, trade secret, copyright, publicity, privacy or other rights of any party;
  7. upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes";
  8. upload, post, email or otherwise transmit any Material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  9. disrupt the normal flow of dialogue or flow of messages or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
  10. interfere with or disrupt the Websites or servers or networks connected to the Websites, or disobey any requirements, procedures, policies or regulations of networks connected to the Websites; or
  11. "stalk," otherwise harass another, attempt or threaten to reveal the identity of another user of the service; or
  12. collect or store personal data about other users.
No Obligation to Monitor; Right to Remove Content

You acknowledge that Already Bored does not (and has no obligation to) pre-screen or monitor User Content, but that Already Bored and its designees shall have the right (but not the obligation) in their sole discretion to post or remove or edit, in whole or in part, any User Content on or from the Websites, or refuse to do the same. Already Bored and its designees shall have the right to remove any User Content that violates the User Terms or is otherwise objectionable as determined in the sole discretion of Already Bored.

You acknowledge and agree that Already Bored may preserve User Content and may also disclose User Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Use Terms; (c) respond to claims that any User Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Already Bored, its users and the public.
